Global AML Regulations & Their Regulators
The Financial Action Task Force (FATF)

The Financial Action Task Force (FATF) is an intergovernmental organization that aims to prevent money laundering and terrorist financing. A global body with 36 members, the FATF encompasses every major financial center and spans the globe. Among its primary responsibilities is setting global AML compliance standards and monitoring their effective implementation. This objective is pursued by the FATF through regular updates to its AML/CTF Guidance.

EU 5AMLD and 6AMLD

AML/CFT legislation across EU member states is harmonized by the European Union's Anti-Money Laundering Directives.

  • 5AMLD: The Fifth Anti-Money Laundering Directive (5AMLD) aims to regulate cryptocurrency by defining cryptocurrencies, imposing reporting obligations, and defining crypto wallets. Among the new provisions in 5MLD are requirements regarding prepaid cards, high-value transactions, beneficial ownership, customers from high-risk countries, and Politically Exposed Persons (PEP).
  • 6AMLD: The Sixth Anti-Money Laundering Directive (6AMLD) includes provisions for harmonizing money laundering definitions, extending the scope of money laundering and criminalizing its associated activities, and toughening punishments.
The Financial Conduct Authority (FCA)

As an independent, non-government organization, the Financial Conduct Authority (FCA) regulates the UK's financial services industry. Its mission includes combating money laundering and other criminal activities, such as terrorist financing. A broad objective of the FCA is to protect consumers, ensure market integrity and stability and promote competition. Aside from enforcing rules and investigating those who violate them, it also has the authority to introduce new ones.

The Bank Secrecy Act (BSA)

The Financial Crimes Enforcement Network (FinCEN) administers the Bank Secrecy Act (BSA), which is the primary anti-money laundering law of the United States. Money laundering is the primary focus of the BSA, but it has also expanded to protect against other financial crimes. In 2001, the Patriot Act amended it to include measures to counter-terrorist financing (CTF).

Monetary Authority of Singapore (MAS)

The Monetary Authority of Singapore (MAS) has the role of acting as the central bank and regulatory body for the city-state's financial sector. As a central bank, MAS is responsible for conducting monetary policy, supervising financial institutions, managing Singapore's assets and reserves, and advancing Singapore's international financial status. The MAS' anti-money laundering and counter-terror financing policy must be followed by financial institutions.

Australian Transaction Reports and Analysis Centre (AUSTRAC)

The Australian Transaction Reports and Analysis Centre (AUSTRAC) provides financial intelligence to the Australian government for the purpose of fighting money laundering, terrorism financing, fraud, and other financial crimes. AUSTRAC is a federal agency that identifies criminal threats and abuses of the Australian financial system, working under the Anti-Money Laundering and Counter-Terrorism Financing Act (2006).
